If you were recently arrested for driving under the influence in Alabama, you may think the only option you have is to plead guilty and take whatever sentence the judge gives you.
What you may not realize, however, is just how serious the penalties for DUI really are. In addition to a mandatory driver’s license suspension, you may spend time behind bars, and pay massive Alabama DUI fines.
Under Alabama law, drivers are not allowed to operate any type of motor vehicle with a blood alcohol content (BAC) of 0.08% or higher. As a result, you can be charged with per se DUI if you take a breath test and the results indicate an illegal BAC—even if your driving abilities were not impaired. At the same time, however, you can still be charged with DUI if your BAC is well below the legal limit, and you are driving in a manner that indicates alcohol impairment.
Regardless of the reason for your arrest, the penalties for a DUI conviction are severe. First-time offenders face up to a one-year jail sentence, fines ranging from $600 to $2,100, and a 90-day license suspension. If you are convicted of two DUIs within five years, expect mandatory jail time (ranging anywhere from five days to one year), fines of $1,100 to $5,100, and a minimum 90-day license suspension.
If it’s your third conviction for DUI within five years, you will most likely serve at least 60 days in jail, lose your license for a year or longer, and pay up to $10,100 in DUI fines. For your fourth offense, you’ll face felony DUI charges, which means a conviction can put you behind bars for a year or longer; cost you at least $5,100, and all the way up to $10,1000, in fines; and leave you stuck with public transportation for the next five years.
