Alabama DUI Appeals

Alabama DUI Appeals
Each year, hundreds of Alabama drivers are arrested, charged, and convicted of driving under the influence (DUI). If you are one of these individuals, you may think there’s nothing you can do—after all, you’ve already been found guilty, so what choice do you have? Unbeknown to many DUI offenders, you may be able to challenge your conviction by submitting a request to the Alabama DUI appeals court.

An appeal trial is not a new trial, but simply a review of the previous one. By appealing your conviction, you are essentially asking a higher court to review your case to ensure the ruling was fair. There are many valid reasons a person may want to request an appeal—for example, if you believe the sentence was too harsh for the offense or your Constitutional rights were violated, your conviction may have been unwarranted.

In order for your appeal request to be approved by the court, you must submit evidence to prove that your original trial was unfair. This means you cannot submit any new evidence, but instead must review transcripts and other documents from your first trial to determine an appropriate legal reason for requesting an appeal.

Once you have determined the legal grounds for your appeal, you will need to submit a formal request to the appropriate appellate court in your jurisdiction. As part of this request, you will not only need to present evidence to support your request, but also provide a detailed explanation of why you are asking the court to review your case.

Be aware that the prosecution will be submitting its own evidence to prove your first trial was fair and should not be appealed. As a result, it is extremely important to prepare a detailed and convincing argument to support your request—an extremely difficult undertaking if you are not well-versed in Alabama’s DUI laws.
