2nd Offense DUI Alabama
Are you one of the many Alabama drivers who were arrested for driving under the influence (DUI)?
If so, you may already realize the seriousness of these allegations—and if it’s a 2nd offense DUI in Alabama, the charges are all the more severe.
Alabama’s DUI laws are designed to keep repeat offenders off the roads. In the eyes of the law, anyone who has been convicted of driving under the influence within the past five years is considered a repeat offender. As a result, the penalties for a 2nd DUI offense are much harsher than those associated with a first offense.
In most cases, once the DMV is notified of your new DUI arrest, they will immediately suspend your driver’s license for 90 days. You have ten days to appeal this suspension by requesting an administrative hearing with the DMV—otherwise, the suspension will be upheld. Once your case is reviewed by the DMV in civil court, you may face an additional license suspension if you are found guilty.
The criminal punishments for a 2nd DUI offense often include jail time. Depending on the circumstances surrounding your arrest, the length of your sentence can be anywhere from five days to a year. The court may also order you to enroll in a substance abuse treatment program, impose a fine of $1,100 to $5,100, and suspend your driving privileges and/or vehicle registration—and these penalties are separate from those imposed by the DMV in civil court.
Fortunately, with the right legal representation, you may be able to avoid many of the penalties associated with a 2nd DUI offense—and attorney Whitney B. Polson and his team have a reputation for doing just that.
